This Product Performance Disclaimer forms an integral part of:
● the Airturb General Terms and Conditions
● the Airturb Product Warranty Policy
● any sales agreement or purchase order involving Airturb products.
Airturb products generate electrical energy using wind as a natural and variable resource.
Wind conditions depend on numerous environmental factors beyond the control of Airturb, including but not limited to:
• wind speed and direction
• turbulence caused by surrounding buildings
• terrain conditions
• installation height
• weather patterns
• seasonal fluctuations
• urban wind effects.
Because of this variability, wind energy production cannot be guaranteed.
Airturb does not guarantee any specific energy production level, output capacity, or annual energy yield.
Any references to:
• expected production
• estimated kWh output
• performance curves
• yield projections
• return on investment
• payback periods
are indicative estimates only.
Actual performance may differ significantly depending on site conditions.
The customer, developer, installer, or project owner is solely responsible for determining whether a specific location is suitable for wind energy generation.
Airturb shall not be responsible for inadequate site conditions, including:
• insufficient wind resource
• excessive turbulence
• structural limitations
• unsuitable mounting locations.
Airturb may offer Wind Resource Assessments (WRA) as a paid advisory service.
These assessments are based on available data, modeling, and assumptions.
Wind Resource Assessments:
• provide indicative estimates
• cannot guarantee actual energy production
• cannot guarantee financial project performance.
All technical documents provided by Airturb, including:
• brochures
• datasheets
• technical drawings
• presentations
• marketing materials
• performance graphs
are provided for informational purposes only.
Unless explicitly stated otherwise in a written contract, such documents do not constitute performance guarantees.
Performance of wind turbines may be affected by environmental conditions including:
• extreme weather events
• storms
• icing
• lightning
• salt corrosion
• pollution
• structural vibrations.
Airturb shall not be liable for performance variations caused by such environmental conditions.
Distributors, partners, installers, and resellers are not authorized to make performance guarantees on behalf of Airturb unless explicitly approved in writing.
Airturb shall not be liable for representations made by third parties that exceed official product specifications.
To the maximum extent permitted by law, Airturb shall not be liable for:
• loss of energy production
• loss of revenue
• loss of profits
• project underperformance
• financial losses related to energy generation.
This disclaimer is governed by Dutch law.
Any disputes shall be submitted exclusively to the competent court in Rotterdam.
